NEW CLIENT RELEASE

AGREEMENT, RELEASE, AND MEDICAL POWER OF ATTORNEY


The following terms of service (“Terms”) govern your use of Akita services, including our website (www.Akitapetcare.com) and pet care services (the “Services”), and are entered into by you and Akita, Inc., a Georgia corporation (“Akita”). By using the Services, you agree to be bound by these Terms.

1. VACCINATIONS

I confirm that my pet is currently vaccinated against Rabies, Distemper, Lepto, Adenovirus, Parainfluenza, Parvovirus, Bordetella, and (if applicable) Feline Viral Rhinotracheitis and Feline Calicivirus. I understand Akita will not be held accountable, liable, or responsible for any pet that is not properly vaccinated.

2. AVAILABILITY

I understand that while Akita will make every effort to accommodate specific time slots requested, that given the nature of the business, Akita cannot guarantee arrival or departure times. In the event of severe weather that is deemed unsafe to pets and/or service providers, Akita reserves the right to modify services to ensure safety. Akita also reserves the right to cancel services if weather conditions, travel conditions or other circumstances are deemed unsafe by Akita.

3. CANCELLATIONS AND REFUNDS

I understand that Akita maintains a cancellation policy requiring 24 hours' advance notice for the cancellation of scheduled or requested services. If a service is cancelled with less than 24 hours' advance notice, I understand I will not receive a refund for the scheduled service. I further understand that services scheduled or requested same-day are non-refundable.

4. PHOTO AND VIDEO RELEASE

I understand that while in the company of Akita, my pet may be photographed and/or videotaped. I understand these materials help to document service delivery and may be utilized in materials that are sent to investors, customers, or used in promotional materials. I understand that I will not receive compensation for the use of my pet's photos and/or videos.

5. VETERINARY CARE

If my pet should be injured, appear sick, or otherwise reasonably appears to require immediate veterinary attention as determined by Akita, I authorize Akita to consult with any veterinarian for treatment or guidance. I authorize Akita to utilize the services of any veterinarian selected by Akita. I understand that I am responsible for any charges, including transportation costs, incurred with respect to any such veterinary services.

6. GROCERY DELIVERY

I understand Akita cannot guarantee availability of desired items and such items may (with permission) be replaced with alternatives or cancelled. I understand my account will be billed for the full amount of items plus a $10 delivery fee. I understand I can cancel my delivery up until Akita begins shopping for my order. If I must cancel my order during the shopping or delivery process, I understand my account will be billed for the full amount of any items purchased plus a $10 delivery fee.

7. REFUSAL OF SERVICE

I understand Akita reserves the right to refuse or discontinue service to any person or pet for any reason, including, but not limited to, delinquent accounts, pets with aggressive tendencies, and failure to provide proof of vaccination.

8. ASSUMPTION OF RISK

I give Akita permission to care for my pet and to take any and all steps reasonably necessary in providing such care. Akita may use leashes, harnesses or other appropriate means to safely handle my pet. I understand that Akita is not responsible or liable for any of the following: injuries or death to my pet caused by other animals; diseases or ailments which my pet may contract from other animals, including infections and viruses; falls; theft; collisions with vehicles; running away; natural disasters; fire; the unavailability of emergency medical care or any items necessary for the care of my pet due to circumstances beyond the control of Akita (including food, water, medicine, and electricity); the negligence, recklessness or deliberate acts of third parties; or injuries or death to my pet caused by themselves.

9. RELEASE OF LIABILITY AND INDEMNIFICATION

I hereby release Akita, its shareholders, officers, directors, employees, contractors, agents, or any other persons or entities involved with the services provided by Akita from all actions, suits or claims for injury, loss or damage regardless of the cause, including negligence or recklessness. I also release the residential property, including its owners, managers, and all other employees ("Property") which Akita occupies, from all actions, suits or claims for injury, loss or damage regardless of the cause. I understand and acknowledge that pets may cause damage to themselves, other animals, persons or property. I agree to indemnify and hold harmless Akita and Property for any and all losses, liabilities, demands, expenses, claims and suits, including any legal, veterinary or other fees Akita or Property may incur as a result of any damage caused by my pet, and I agree to defend Akita and Property against such. It is the intention of the parties that the foregoing releases shall be effective as a bar to all actions, claims, losses, liabilities, damages or costs, of any kind or nature, known or unknown, foreseeable or unforeseeable, arising out of the performances of Akita services. The parties expressly agree that this release of liability and indemnification shall be given full force and effect in accordance with each and all of its terms and provisions.

I hereby indemnify and hold Property harmless for any and all claims that may be caused by, or arise from the hiring and/or engaging of services of Akita, including but not limited to personal injury, injury to or the illness of my pet or the pet of another including death; theft or loss; property damages caused by Akita in the performance of its duties; and property damages caused by my pet. I assume full responsibility and liability for any damages caused to and by my pet while engaging the services of Akita.
